Repaying the Reimbursement Fixed Costs (TVL)
Did you receive Reimbursement Fixed Costs (TVL)? And did your turnover exceed your expectations? You may have received more than you were entitled to. If you did receive too much TVL, you will need to pay back the amount in excess.
Do you have to repay?
The Netherlands Enterprise Agency (RVO) will send you a settlement letter (vaststellingsbrief) to let you know if you have to repay (part of) TVL. If you have received more TVL than you were entitled to based on your actual turnover, you will have to repay the amount you received in excess. For instance, because your turnover was more than you expected when filing your application for TVL.
After each subsidy period RVO sends you a request by email to supply your actual turnover for the period. RVO then calculates the final subsidy amount you are entitled to.
Afterwards you will receive a letter from RVO with the final settlement. In this settlement letter the final calculation of TVL you are entitled to, and the amount you will have to repay is specified. It may be the case that you do not have to repay at all or even that you will receive an additional amount from RVO.
Amounts of up to €500 are waived. This means that if you have to repay an amount of less than €500 you do not have to repay it.
How much do you have to repay?
If you have to repay, it may be that you have to repay part of the reimbursement or the whole amount. The amount you must repay depends on your situation and is specified in the settlement letter.
You do not have to pay interest on the amount you need to repay.
Tax exemption for TVL
If you are entitled to TVL it will not be counted towards your taxable profit. This means it will be exempt from income tax (inkomstenbelasting) or corporate income tax (vennootschapsbelasting).
When do you have to repay?
If you have to repay (part of) TVL, you must do so immediately. You can do this in one go, within 6 weeks of receiving the settlement letter.
If you have to repay consecutive TVL periods, the payment periods will be consecutive as well. For example, you have to pay the excess amount for TVL Q4 2020 before you pay the excess amount for TVL Q2021.
Payment arrangement
If you cannot pay in one go, you can:
- ask RVO for a payment arrangement (betalingsregeling, in Dutch) under conditions RVO will explain beforehand. You can choose to pay in 6, 12, 18, or 24 monthly instalments.
- ask RVO for a personal payment arrangement. In that case choose the option 'terugbelverzoek' (callback request) when you apply for a payment arrangement (betalingsregeling, in Dutch). RVO will then contact you.
Just as for paying in one go, you do not have to pay interest.
Whom do you repay?
You will have to pay any excess amount in TVL support to the Netherlands Enterprise Agency (Rijksdienst voor Ondernemend Nederland, RVO). This is the agency you also received the reimbursement from. Read more on the repayment options (in Dutch).
