Code of conduct will be mandatory in the workplace

What changes?

Do you have 10 or more employees? You will be obliged to have a code of conduct to prevent improper conduct in the workplace. Improper conduct is for example, bullying, sexual intimidation, discrimination, aggression, or violence by colleagues or management.

You need to describe what is and what is not allowed during work in a clear code conduct. You also have to inform your staff on these rules. This way all employees will know where they stand. Businesses can fill in the code of conduct themselves, as long as it meets basic requirements.

The code of conduct should make it clear to employers what behaviour they can and cannot show.

Small businesses with fewer than 10 employees do not have to draw up a code of conduct.

When?

It is not yet known when this change in the Working Conditions Act (Arbeidsomstandighedenwet or Arbowet) will take effect.

Internet consultation: You can give your opinion on this proposed change in law until 23 March 2025 (in Dutch).

Please note: The effective date of this measure is not yet final. Entry into force is subject to its passing through the Lower and Upper Houses (Tweede en Eerste Kamer) of parliament. After publication in the Staatsblad or Staatscourant (Government Gazette, in Dutch) the law can take effect.
